Terms of service
The rules for our website, our studio app and the lessons themselves. Written in plain language, because they are no use to anybody otherwise.
1. Who we are, and what these cover
Launchpad Music Academy is a music school offering private and small group lessons. It is operated by 5thn Music LLC. “Launchpad,” “we,” “us” and “our” mean that business.
These terms apply to:
- our website, launchpadmusicacademy.com
- our studio app, app.launchpadmusicacademy.com
- lessons and classes you enroll in with us
“You” means the person using the website or app. For a student under 18 it also means the student’s parent or legal guardian, who agrees to these terms for the family.
Each family also signs a lesson agreement in the app. It sets out your student’s teacher, weekly time, rate and billing arrangement. If the lesson agreement you signed and these terms disagree about a lesson, billing or cancellation matter, the lesson agreement you signed wins.
Our privacy policy explains how we handle personal information, and it is part of these terms.
2. Agreeing to them
By using the website or app, or by enrolling a student, you agree to these terms. If you do not agree, please do not use the website or app.
You must be 18 or older to accept them. A student under 18 may use the app only under a parent or guardian’s account and permission.
3. Accounts
- By invitation only. The studio creates accounts and sends invitations. There is no public signup.
- Roles. Accounts are for our owner, manager, teachers, parents and students, and each role sees only what it needs.
- No student under 13 gets a login. Younger students use their parent’s account.
- Parents are responsible for their family’s accounts, including any student login we create at your request.
- Only a parent, guardian or adult student can sign the lesson agreement or make billing decisions. Students cannot.
- Keep your password private. Do not share your login. Email us straight away if you think somebody else has used it.
- Keep your details current, especially your email, so reminders and invoices reach you.
4. Acceptable use
When using the website or app, you agree not to:
- use someone else’s account, or let someone else use yours
- try to see information about another family, student or teacher
- try to break, overload, probe or get around the security of the website or app
- copy, scrape or resell our content or curriculum
- upload anything unlawful, harassing, hateful, sexual or harmful, including in practice logs
- contact a minor student except through the studio and the student’s parent
- use the website or app for anything other than taking part in lessons at Launchpad
We may suspend or remove access for anyone who breaks these rules.
5. Lessons
Location. Lessons take place at 818 SW 7th Avenue, Amarillo, Texas, inside Spacecamp Studios. The building is private and locked. There are no walk ins. Please arrive for your scheduled time only, and do not let anyone else into the building.
Private lessons are held at a fixed weekly day and time agreed at enrollment.
Group classes run 75 minutes, with 3 to 6 students grouped by playing level. If fewer than 3 students enroll, a class may be postponed or cancelled. If that happens we will contact each family personally, and you get a refund or a credit for any class that does not run.
Materials are included. Books, sheet music, tab and teaching aids are part of tuition. Students bring their own instrument.
Waiting. A student waiting for a lesson, or a brother or sister waiting with them, waits in the lesson room. Children may not wander the rest of the building. The studio is responsible for a student during their scheduled lesson time.
Dropping off. You are welcome to stay for your student’s lesson, and many parents do. You may also drop off and come back. If you do, a parent or guardian must be reachable by phone for the whole lesson and back at the end time. A student is released only to a parent, a guardian, or an adult a parent has told us about.
Not a licensed child care program. Launchpad provides direct instruction in music only. It is not licensed by the State of Texas as a child care facility, and it is not a day care or a before or after school program. Please do not treat lessons as child care.
Physical activity and risks. Learning an instrument is a physical activity. Risks include sustained loud sound, especially drums and amplified instruments. Students can get strain or soreness in the hands, wrists, back or voice from practice, and can trip on or bump into cables, stands and equipment. We work to keep rooms safe and volumes sensible. Please tell us about any health condition, injury or hearing concern that affects how your student should play.
Safety. Spacecamp has security cameras in the lesson rooms and common areas, there for the safety of students and teachers alike. See our privacy policy. Every teacher who works with children has a criminal background check on file before they teach.
6. Tuition and payment
No registration fee. You pay only for lessons and classes.
Rates. $30 for a 30 minute lesson and $50 for a 60 minute lesson. Your own rate is shown in your lesson agreement and on your invoice.
Monthly tuition, for families enrolling from September 2026. Tuition is prepaid for the whole month, and is due between the 25th of the previous month and the 5th of the month. October tuition, for example, is paid between September 25 and October 5.
Weekly pay, for families enrolled before September 2026. Those families keep the arrangement and the rate they already have. They are billed only for lessons that actually happen. We will never move a family to monthly tuition without talking to them first.
How to pay. Card payments are processed by Stripe, and we never see or store your full card number. If you pay another way, we record it against your invoice. If you set up automatic payment we will tell you the amount and the date before it is charged, and you can turn it off in the app or by emailing us.
Late payment. If monthly tuition is not paid by the 5th, lessons are paused until it is. We send one note, by email and in the app, before that happens. Paying in full lifts it straight away. Families on weekly pay are never paused.
7. Cancelling a lesson
Monthly tuition. Tell us 24 hours or more before a lesson and you can book one makeup lesson that month at no charge. Makeups happen in the same month and do not carry over. With under 24 hours’ notice, or a second cancellation in the same month, the lesson is not made up.
Weekly pay. Cancelling costs nothing, whatever the notice, and a missed lesson is not charged. Please tell us as early as you can so your teacher can plan.
How to give notice. Cancel in the app, or email launchpadmusicacademy@gmail.com. Notice counts from the time your cancellation reaches us, in real hours rather than calendar days. A message at 9:00 am Monday about a 3:00 pm Wednesday lesson is 54 hours of notice.
If we cancel. If the studio cancels a lesson for any reason, including teacher illness, weather or a building problem, you are never charged for it. We reschedule it. If no time works for you it becomes a credit on your account, or a refund if you ask.
8. Leaving, and refunds
Ending lessons. You may end enrollment at any time by telling us in writing, by email or in the app.
No refunds. Tuition already paid is not refunded, and unused lessons and account credits are not paid out in cash. The studio may choose to make an exception, at its own discretion.
If we end enrollment, we refund all prepaid tuition for lessons not taught.
How refunds are paid. Back to the original payment method, or another we agree with you, within 14 days.
9. Changes to prices and policies
We may change rates or policies, and will give at least 30 days’ notice by email before a change affects you. A change to your lesson terms takes effect only when you sign a new version of the lesson agreement. Until then the version you signed continues to apply. If you do not accept a change you may end enrollment before it takes effect.
10. Our content and yours
Ours. The curriculum, lesson materials, practice tools, website, app, and the Launchpad name and logo belong to Launchpad or its licensors. While enrolled you may use them for your own family’s learning. You may not copy them for others, sell them, or use them to teach outside Launchpad.
Yours. Practice logs and anything else you or your student enter in the app remain yours. You give us permission to store and use them to teach your student and run the studio, as described in our privacy policy.
Photos and video. We never photograph or film a student without asking a parent first. If you say no, that is the end of it.
11. The website and app
We work to keep them available and accurate, but they may sometimes be down for maintenance or have errors, and we may change or retire features.
The tuner and sight reading tools use your device’s microphone inside your browser only. Nothing is recorded or sent to us. They are practice aids, not a substitute for your teacher.
The website and app are provided “as is.” To the fullest extent Texas law allows, we make no promises beyond those stated in these terms.
12. Limitation of liability
Please read this section carefully. It limits what you can recover from us.
To the fullest extent permitted by law:
- Launchpad is not liable for indirect, incidental, special or consequential damages arising from the website, the app or these terms, including lost data or lost opportunities.
- Launchpad’s total liability for any claim about the website, the app or tuition is limited to the amount you paid us in the 3 months before the claim arose.
- Launchpad is not responsible for loss of or damage to personal belongings, including instruments, brought into the building, unless we caused it by our negligence. Studio gear is ours to maintain: if something of ours breaks in normal use, that is ours to fix.
These limits do not apply to the extent the law does not allow them. That includes liability for our gross negligence or intentional misconduct, and any rights you have under the Texas Deceptive Trade Practices Act that cannot be waived. Nothing in these terms limits any claim a minor child has for personal injury where Texas law does not permit that claim to be limited.
13. Suspending or ending access
We may suspend or close an account that breaks these terms, puts anyone’s safety at risk, or is used to reach another family’s information. If we close a family’s account we refund prepaid tuition for lessons not taught.
14. Disputes and Texas law
Talk to us first. Email launchpadmusicacademy@gmail.com or speak with Grant Fithen. Most things get fixed in one conversation. If that does not work, both sides agree to try mediation in good faith before going to court.
Governing law. These terms are governed by the laws of the State of Texas, without regard to conflict of law rules.
Where disputes are heard. Any court case will be brought in the state or federal courts in Potter County, Texas, where the studio is. Either side may still use small claims court for a claim within its limits.
Severability. If any part of these terms is found unenforceable, the rest stays in effect.
15. Changes to these terms
We may update these terms. We will change the effective date at the top and email families about any significant change at least 30 days before it takes effect. Continuing to use the website or app after that means you accept the updated terms. Changes to your lesson terms still require a newly signed lesson agreement, as explained in section 9.
